The present article aimed to analyze the risks faced by the elderly in contracting payroll loans. The research investigated abusive practices, banking fraud, lack of clarity in contracts, and vulnerability to over-indebtedness. The study highlighted the importance of protecting the rights of the elderly, who are often targets of unfair practices by financial institutions. Considering the increase in life expectancy and the greater participation of the elderly in the financial market, it becomes imperative to address this issue. The elderly face problems due to insufficient adequate information about contracts and the expansion of the consignable margin. The elderly consumer is in a vulnerable position concerning these types of actions, which frequently result in over-indebtedness and financial difficulties. Criticisms were made of the current legislation, especially regarding the increase in the consignable margin. The research method used was qualitative, with bibliographical reviews that include analyses of books, academic articles, jurisprudence, doctrines, and legal texts. By analyzing the behavior of financial institutions concerning the elderly, the article emphasized the need for implementing measures that ensure the dignity and well-being of this population, thus strengthening their protection.
