Abstract

This article had the general objective of investigating the limits of freedom of expression within social networks. It sought to answer the following research problem: to what extent can the exercise of freedom of expression on social networks generate moral damage? Its purpose was to demonstrate that this right is a constitutional guarantee, which has requirements and limits for its exercise, with this freedom being a democratic form inherent to all individuals, which cannot be violated. Antagonism to the limits of freedom of expression is enough to promote a better distinction in the civil and criminal spheres. Faced with the violation of this right, individuals are held responsible, because although it is a guarantee for the entire community, it is restricted to the degradation of private life, honor and image. Social networks can influence the way people express themselves and how they materialize information, given their breadth, the result is the lack of a regulatory standard from this perspective, making it difficult for society to have adequate standards. It states that this article adopted bibliographic, qualitative and documentary research methodology. Freedom of expression, even though it has legal force over a given asset, takes the form of a limitation on intellectual, artistic, scientific and communicative expression protected by section IX of article 5 of the Federal Constitution.
