Abstract

This study investigates the issue of exploiting workers' images in digital environments, especially on social media, where the boundary between corporate promotion and respect for personality rights often becomes blurred. The lack of specific regulation in Brazilian labor law regarding the use of employee images for commercial purposes increases the risk of abusive practices, undermining workers' dignity and right to privacy. In this context, the general objective of this research is to analyze the legal and ethical implications of using workers' images in corporate promotional campaigns, focusing on the protection of their fundamental rights. To achieve this, the study aims to examine workers' personality rights regarding their image, highlighting the legal support and requirements for express consent; identify the absence of specific regulation in the Consolidation of Labor Laws (CLT) and the gaps that allow the improper exploitation of workers' images; and discuss national jurisprudence which, although limited, reinforces the right to image as a fundamental protection, suggesting that unauthorized use should result in compensation. Using a qualitative approach based on bibliographic and documentary research, the results demonstrate the need for greater awareness and justice in handling workers' images, emphasizing the importance of business practices that respect employees' dignity. This study contributes to a more ethical and productive work environment, encouraging the establishment of clear and respectful policies regarding the use of images in commercial contexts.
